Introduction

The provisions of California Code of Regulations section 599.676.1 provide that upon movement to a classification with a higher salary range, civil service employees designated managerial under California Government Code 3513 (e), Ralph C. Dills Act, are entitled to a salary range one step above the last rate received.  If geographic relocation is required as a result of this movement, as recommended by the appointing power, the employee may receive up to two steps above the rate last received.

Statement

The provisions of this section apply only to state civil service employees designated managerial under Government Code section 3513(e) of the Ralph C. Dills Act.

A permanent or probationary employee who, without a break in service, moves to another class with a higher salary range shall be entitled to the rate in the salary range one step above the rate last received. When such movement requires a change in geographic location the employee may, as recommended by the appointing power, receive up to two steps above the rate last received provided the rate does not exceed the maximum rate of the higher salary range.

Such movement may be in the same or to another agency and by appointment from an employment list, by temporary appointment, or by reinstatement. A new salary anniversary date is established subject to the provisions of California Government Code sections 599.683 and 599.685.

Pursuant to California Code of Regulations, title 2, section 599.666.1 (b), “step” for employees compensated on a monthly basis is a 5-percent differential above or below a salary rate rounded to the nearest dollar, and for employees compensated on a daily or hourly basis is a 5-percent differential above or below a rate rounded to the nearest dollar and cents amount.

Pursuant to California Code of Regulations, title 2, section 599.666.1 (f), “higher salary range” is a salary range with the maximum salary range at least two steps higher than the maximum salary rate of another salary range.
