This policy

  • Provides information on employee pay when deployed by the National Disaster Medical System (NDMS).

Introduction

The NDMS is a federally coordinated system that augments the nation’s medical response capability. NDMS members are intermittent federal employees and their service is considered service in the uniformed services for purposes of coverage under the Uniformed Services Employment and Reemployment Rights Act (USERRA). While activation for NDMS training or NDMS deployment is not military leave, and thus NDMS members are not entitled to military pay pursuant to Government Code section 19770 et seq., NDMS members are to be treated similarly to employees on comparable non-military leave.

Statement

Upon an employee’s presentation of NDMS activation deployment orders to their supervisor, the employee must be allowed the specified time off.

Employees who receive NDMS training orders are eligible to receive up to 30 calendar days of Administrative Time Off (ATO) per fiscal year. Employees who receive NDMS deployment orders for an emergency event are eligible to receive up to 30 calendar days of ATO per emergency event order. Requests for ATO extensions beyond 30 calendar days must be submitted to CalHR and will be determined on a case-by-case basis. Employees who do not have ATO extensions approved may use their available leave credits or take a leave of absence for the remainder of the deployment.

General Procedures

Employees ordered to active duty must notify their employer by providing a copy of their NDMS orders as soon as reasonably possible. An employee must also be given sufficient time to travel to the place where NDMS duty is to be performed.
